1. About these Terms
These Terms and Conditions ("Terms") apply when you use kebabcarvery.com, create an account, place an order, request delivery or collection, use a voucher or promotion, or otherwise purchase products from Kebab Carvery (Bognor Branch) ("Kebab Carvery", "we", "us" or "our").
Please read these Terms before placing an order. By submitting an order, you confirm that you have read and agree to them. Nothing in these Terms limits rights that cannot lawfully be excluded under the Consumer Rights Act 2015 or other applicable consumer law.

3. Eligibility and customer responsibility
You must be legally capable of entering into a binding contract. You are responsible for:
providing complete and accurate account, contact, address and order information;
ensuring that you are authorised to use the selected payment method;
checking your basket, quantities, options, delivery or collection choice, address and requested time before payment;
keeping account credentials secure;
being available to receive a delivery or collect an order at the agreed time;
telling us about allergies or dietary requirements before ordering.
You must not misuse the website, attempt unauthorised access, submit fraudulent orders, interfere with security or use automated tools to scrape or disrupt the service.
4. Products, descriptions and availability
We take reasonable care to describe products accurately. Images are illustrative and actual products may vary in size, appearance, ingredients or presentation.
All products are subject to availability. We may:
reject an order before acceptance;
remove or change products;
substitute an unavailable item only after obtaining your agreement, unless you have clearly authorised suitable substitutions;
contact you to agree an alternative;
cancel and refund the affected item or order where no suitable solution is available.
We will not charge you for an unauthorised higher-priced substitute.
5. Allergies and dietary information
Important: Our kitchen handles multiple allergens. Although we take reasonable precautions, we cannot guarantee that any product is completely free from allergens or cross-contamination.
If you have an allergy, intolerance, coeliac disease or other serious dietary requirement:
contact the restaurant directly before placing the order;
do not rely solely on menu names, icons, filters or free-text notes;
confirm that the restaurant can safely accommodate your requirement;
identify the affected person and relevant allergen clearly.
A request entered only in an order note is not confirmation that the request can be fulfilled. If we cannot safely accommodate a requirement, we may refuse or cancel the affected order and refund the relevant amount.
6. Prices, taxes and charges
Prices are shown in pounds sterling unless stated otherwise. Prices include VAT where applicable.
Before you submit the order, the checkout will display the total payable, including applicable:
product prices;
selected extras or options;
delivery charges;
bag or packaging charges;
mandatory service or processing charges;
discounts or promotional credits.
Optional extras will not be added without your agreement. We may correct obvious pricing errors. If an error affects an order already submitted, we will contact you and allow you to confirm the corrected price or cancel for a full refund.
Prices and availability may differ between delivery, collection, in-store and third-party platforms.
7. Placing an order and contract formation
The website guides you through the steps required to place an order. You can review and correct the basket before submitting it.
An order submitted through the website is an offer to purchase. An automated acknowledgement confirms receipt but does not necessarily mean the order has been accepted.
The contract is formed when we expressly accept the order, begin preparation, or otherwise confirm acceptance through the website, email, SMS or telephone. We may decline an order before acceptance, including because:
an item is unavailable;
the delivery address is outside our service area;
the order does not meet a disclosed minimum value;
payment cannot be authorised;
the order appears fraudulent or abusive;
there is an obvious price or description error;
we cannot safely fulfil an allergy request;
the restaurant is closed or operational capacity has been reached.
If payment was taken for an order we do not accept, we will arrange a refund.
8. Payment
Available payment methods are shown at checkout. Online card payments may be handled by a third-party payment provider under its own terms and privacy notice.
You authorise the payment provider and us to take the displayed amount. Payment may be pre-authorised or captured when the order is accepted. We are not responsible for delays caused by your bank or card issuer.
Where cash payment is available, you must pay the amount due on delivery or collection. We may restrict cash orders, require exact payment or refuse large-denomination notes for security reasons.
9. Delivery
Delivery availability, estimated times, charges, minimum order values and postcode restrictions are shown during ordering.
Delivery times are estimates, not guaranteed appointment times. Delays may occur because of traffic, weather, demand, kitchen capacity, road closures, safety issues or events outside our reasonable control. We will take reasonable steps to keep you informed of material delays.
You must provide a complete, accurate and accessible delivery address and contact number. Our delivery obligation is fulfilled when the order is delivered to:
the address provided;
a person apparently authorised to receive it; or
another location you expressly agree with the driver.
If we cannot deliver because the address is incorrect, access is unsafe, nobody responds, or you are unavailable after reasonable attempts to contact you, we may treat the order as completed and may not be able to offer a refund, particularly where food has already been prepared.
Risk in the products passes to you on delivery. You should check the order promptly and contact us as soon as possible if anything is missing, damaged, incorrect or unsafe.
10. Collection
You must collect the order from the stated branch during opening hours and provide the order number or other reasonable verification.
Collection times are estimates. Food quality and safety may deteriorate if collection is delayed. If you do not collect within a reasonable time after the order is ready, we may dispose of the food and may not be able to provide a refund because the products are perishable and were prepared specifically for your order.
11. Changes and cancellations
Contact us immediately if you need to change or cancel an order.
Because food is prepared to order, is perishable and may deteriorate rapidly, the usual 14-day cooling-off right generally does not apply to prepared food orders. Your statutory rights remain unaffected where products are faulty, not as described, unsafe or not supplied with reasonable care and skill.
Before preparation begins, we may agree to a change or cancellation and refund. Once preparation has started, ingredients have been committed, or delivery has begun, cancellation or amendment may not be possible. Any charge retained must be reasonable and reflect costs or losses actually incurred.
We may cancel an order where fulfilment becomes impossible or unsafe. In that case, we will refund amounts paid for products not supplied.
12. Problems, complaints and refunds
Contact us promptly if:
an order does not arrive;
an item is missing or incorrect;
food is damaged, unsafe, not of satisfactory quality or materially not as described;
a payment or refund appears incorrect.
We may request the order number, photographs, details of the issue and the affected products. Depending on the circumstances and your legal rights, a remedy may include replacement, redelivery, price reduction or refund.
Refunds are normally made to the original payment method. Processing times depend on the payment provider and bank. These Terms do not make refunds solely discretionary where the law gives you a remedy.
13. Promotions, vouchers and loyalty benefits
Promotions, voucher codes and loyalty benefits:
are subject to any specific conditions displayed with the offer;
may have expiry dates, minimum spends, product, customer, postcode or time restrictions;
cannot be exchanged for cash unless required by law;
may not be combined unless expressly stated;
may be limited to one use per customer, account, household, address, device or payment method;
may be withdrawn where not yet accepted into a contract;
may be cancelled where obtained or used fraudulently, abusively or contrary to the offer conditions.
If a promotion conflicts with these Terms, the specific promotion conditions take priority for that promotion.
14. Customer accounts
You must provide accurate information and keep it current. We may suspend or close an account where we reasonably believe it is being used fraudulently, unlawfully, abusively or in breach of these Terms.
You may request account closure, subject to our need to retain transaction or legal records. Account closure does not automatically erase records we are legally entitled or required to keep.
15. Reviews and user content
If the website allows reviews, comments or other content, you must ensure that the content:
reflects a genuine experience;
is accurate and not misleading;
does not contain unlawful, defamatory, threatening, discriminatory, obscene or infringing material;
does not disclose another person's private information;
is not submitted in exchange for an undisclosed incentive;
is not fake, commissioned or manipulated.
We may moderate or remove content where reasonably necessary to comply with law, protect users or enforce these Terms. We do not promise to publish every review.
16. Intellectual property
The website and its content, including branding, menus, text, graphics, photographs, software and layout, are owned by or licensed to us and are protected by intellectual property law.
You may use the website for personal, non-commercial ordering only. You must not copy, reproduce, distribute, modify, scrape, reverse-engineer or commercially exploit website content without permission, except where law expressly permits it.
17. Website availability and third-party services
We aim to keep the website available and accurate but do not guarantee uninterrupted or error-free operation. We may suspend access for maintenance, security, upgrades or operational reasons.
The website may depend on third-party hosting, maps, payment, messaging or delivery services. We are responsible for our obligations to you but are not liable for a third party's separate service where that third party contracts directly with you.
18. Our responsibility to you
We are responsible for foreseeable loss or damage caused by our breach of these Terms or failure to use reasonable care and skill.
We do not exclude or limit liability where it would be unlawful, including liability for:
death or personal injury caused by negligence;
fraud or fraudulent misrepresentation;
breach of statutory consumer rights;
defective products under applicable product liability law.
We are not responsible for business losses where you purchase as a consumer, or for loss caused by inaccurate information you provided, misuse of the service, failure to follow allergy instructions, or events outside our reasonable control, except where the law provides otherwise.
19. Events outside our reasonable control
We are not responsible for delay or failure caused by events outside our reasonable control, including severe weather, power or network failure, supplier interruption, transport disruption, fire, flood, epidemic, civil emergency, government action or safety incidents. We will take reasonable steps to minimise the impact and contact you where appropriate.
20. Privacy and cookies
Our processing of personal data is described in our Privacy Policy, UK GDPR Data Protection Statement and Cookie Policy.
21. Changes to these Terms
We may update these Terms for legal, regulatory, operational or technical reasons. The version in force when you place an order applies to that order, unless a change is required by law or agreed with you.
22. Governing law and disputes
These Terms are governed by the laws of England and Wales.
If you are a consumer resident in another part of the United Kingdom, you may also bring proceedings in the courts of the part of the UK where you live. Nothing in this section removes mandatory consumer protections.
